“My father was a strong believer in Estate Planning and took every practical step to have one in place. In 2006 he had his first Will, which he proceeded to review only this year. This he did with a codicil (addition) sometime shortly before he passed on. However, between 2006 and 2016 when the codicil was made, a lot had happened – he was already a very sick man and was no longer coherent. He could hardly put two and two together, and also couldn’t sign any document. When he eventually passed on and the Will was read, it was fraught with lots of irregularities: missing pages, irregular numbering of the Will, irregular signature etc. The upsetting aspect was a section of the Will that was purported to have distributed his assets in 2006 signed in 2016, which curiously wasn’t part of the codicil. The entire arrangement now appears messy. Notwithstanding all of these, we, his children are willing to get this resolved and find a solution for the management of his Estate.”
As seen from the case study above, the man had put a plan in place, unfortunately, a seasoned professional was not involved in helping to create the plan.
